The parties and scope
These Terms of Use (the “Terms”) set the rules for using the Kulvar app, the kulvar.unichat.dev site and the services connected to them (“Kulvar” or the “Service”).
Kulvar is built and provided by UniChat (“UniChat”, “we”). You can reach us at support@unichat.dev.
Anyone who uses Kulvar or opens an account (a “User”, “you”) confirms that they have read and accept these Terms, the Privacy Notice and the Cookie Policy. If you don’t accept them, please don’t use the Service. The Turkish version of these Terms prevails.
What the Service is
- Kulvar is a study tracker that helps students preparing for LGS and YKS log and follow their own study. It is not a school, a tutoring centre or a guidance service, and it is not affiliated with ÖSYM, the Ministry of National Education (MEB) or any public authority.
- The Service is under development and opens by invitation. Features may be added, changed or removed over time.
- Kulvar is free for now. Paid features or plans may be offered in the future; a paid service starts only if you accept it.
- Nets, scores, ranking estimates, targets and analyses in Kulvar are for information only. They are estimates based on the data you enter and on commonly used calculation methods; they don’t replace official results and guarantee no exam result or success.
- Kulvar does not provide medical, psychological or professional advice.
Accounts and access
- An account can be opened by invitation or after an access request is approved. UniChat decides at its discretion whether to accept or decline an access request.
- You confirm that the information you give when opening an account is accurate and up to date.
- You are responsible for keeping your account and password secure. Actions taken with your account are treated as yours. Tell us if you notice unauthorised use.
- An account belongs to one person and can’t be transferred.
- If you sign in with a third-party account (for example your Google account), that service’s own terms also apply.
Age and parental permission
- Users under 18 use Kulvar with the knowledge and permission of a parent or legal guardian.
- Students below a certain age can use their account after their parent approves it. By approving, the parent accepts these Terms on the child’s behalf.
- Parents and teachers who access a student’s data confirm that they are authorised to do so and will use the data only to support the student’s education.
Rules of use
When using Kulvar, you agree not to:
- use it in breach of the law, these Terms or the rights of others;
- access another person’s account without permission or act on someone else’s behalf;
- try to get around the Service’s security, reverse-engineer it, overload it, or collect data from it with automated tools;
- upload malware or content that is unlawful or infringes others’ rights;
- use, copy or resell the Service or its content for commercial purposes without permission.
If these rules are broken, UniChat may remove content, or suspend or close the account.
Your content
- The entries and notes you add and the photos you upload to Kulvar (“Content”) are yours.
- You grant UniChat a free, limited licence to store, process, back up and show your Content to the people you choose, in order to provide and improve the Service.
- You confirm that the photos you take of books, tests or other publications are for your personal study and that you have the right to upload them. The user who uploads such content is responsible for any infringement.
- Rights holders can write to support@unichat.dev. We review content reported as unlawful and remove it where necessary.
- Keeping a copy of your Content is your responsibility. You can export your data from the app.
Intellectual property
Kulvar’s name, logo, design, software and texts belong to UniChat or its licensors. These Terms give you a limited, non-transferable and revocable permission to use the Service for personal, non-commercial purposes. No other right is transferred.
Availability of the Service
- The Service is provided “as is” and “as available”. It isn’t guaranteed to be uninterrupted, error-free or suited to every need.
- Kulvar relies on third-party infrastructure services to work. Disruptions caused by outages or changes in those services may be outside UniChat’s control.
- The Service may be paused for maintenance, security or technical reasons.
- UniChat may change or end the Service. Where possible, it gives notice in advance and a reasonable time to export your data.
Limitation of liability
- Kulvar is a study tool. Responsibility for studying, preparing for exams and the decisions that follow lies with the user and their parent.
- To the extent permitted by applicable law, UniChat:
- makes no promise about exam results, success, scores or placement;
- doesn’t guarantee that estimates and analyses are exactly accurate;
- is not liable for indirect damages, loss of profit or opportunity, or loss of data;
- is not liable for users’ actions towards each other or third parties, or for the content they upload.
- Liability that can’t be limited by law is reserved.
- UniChat can’t be held responsible for failing to meet its obligations because of events outside its control (force majeure).
Indemnity
You agree to cover the losses arising from claims and costs that may be brought against UniChat because you breached these Terms or the law. Your statutory rights are reserved.
Closing your account
- You can close your account, or ask for it to be deleted, at any time.
- UniChat may suspend or close an account if these Terms are breached, if it is used unlawfully, if it poses a security risk, or if it has been inactive for a long time.
Changes
UniChat may update these Terms. We announce important changes in a suitable way (for example by email or in the app). Continuing to use the Service after an update means you accept the updated Terms.
Governing law and disputes
- These Terms are governed by the laws of the Republic of Türkiye.
- The Courts and Enforcement Offices of Istanbul have jurisdiction over disputes. Consumers’ statutory rights to apply to Consumer Arbitration Committees and Consumer Courts are reserved.
- UniChat’s electronic records may be used as evidence in disputes.
Other terms
- If a provision of these Terms is found invalid, the others remain in force.
- UniChat not exercising a right doesn’t mean it waives that right.
- Notices may be sent to the email address registered to your account, or in the app.
